1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (agents, builders, developers), these Terms also include the Listing Agreement, incorporated by reference. In case of inconsistency regarding listing specifics, the Listing Agreement prevails.

These Terms apply to all HALP platforms including halp.com.au, boutiquedevelopments.com.au, associated mobile applications and any related websites or services within our network.

2. Description of Services

HALP operates specialized property discovery and business directory platforms — house and land listings, off-the-plan projects, boutique property showcases, school zone integration, mortgage broker connections, and property market insights. HALP is an information and advertising platform: we are not a real estate agent, developer, builder, or financial advisor.

Lead Routing: When you submit a property listing inquiry, it goes directly to the listing agent, developer or builder. HALP does not store or access these inquiries. Inquiries submitted via our Contact Us, Join Us or Advertise With Us forms are collected and managed by HALP under our Privacy Policy.

3. User Accounts and Registration

You must be at least 18 years old and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

4. User Conduct and Prohibited Activities

You agree to comply with all applicable laws and use services only for lawful purposes. Prohibited activities include unauthorized automated access, uploading harmful code, posting false or deceptive content, harassment, and using the platform to compete with our business or aggregate listings for a competing platform.

5. Property Listings and Information

Property listings are provided by third parties. HALP does not own or verify all listing information. Prices, availability and specifications are subject to change. Always verify critical information — including school catchment zones — directly with the property provider, education department or relevant school before making decisions.

6. Business Directory Listings

Advertisers must hold a valid ABN or ACN and comply with Australian Consumer Law. Free listings provide basic directory presence. Premium subscriptions require monthly or annual payment, auto-renew unless cancelled, and are subject to the applicable subscription agreement.

7. Payment Terms (Advertiser Subscriptions)

Fees are in AUD, displayed exclusive of GST unless otherwise stated. Payments are processed via Stripe (PCI-DSS Level 1 certified). Subscriptions auto-renew unless cancelled. You may cancel any time before your next billing date; cancellation takes effect at the end of the current billing period. No refunds for voluntary cancellations. Refunds for technical issues preventing service access are processed within 14 business days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us. We grant users a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for personal, non-commercial purposes.

9. Disclaimers and Limitations

HALP does not provide financial, legal, tax or real estate advice. Calculators and tools provide estimates only. Information may contain errors and property or school data may be outdated. Services are provided "as is" and "as available".

10. Limitation of Liability

To the maximum extent permitted by law, HALP excludes liability for direct, indirect, consequential and incidental damages. Where liability cannot be excluded, it is capped at $100 AUD for free services or, for paid services, the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing in these Terms excludes rights under the Australian Consumer Law.

11. Dispute Resolution

Before initiating legal proceedings you agree to contact us at legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction in NSW courts. Optional arbitration in Sydney under ADRA rules is available.

12. General Provisions

13. Special Terms for Specific Services

Mortgage calculators provide estimates only, not pre-approvals. School zone data is aggregated from public databases and is subject to change — always verify with the school and the Victorian Department of Education. When we connect you with mortgage brokers we may receive a referral fee; brokers are independent third parties.
